No charges for Calif. student in violent arrest

SAN JOSE, Calif. — Prosecutors in California have dismissed charges against a San Jose State University student who was videotaped being struck by police after he allegedly resisted arrest.

The Santa Clara County District Attorney’s office announced Tuesday that Phuong Ho would not face charges of brandishing a deadly weapon and resisting, delaying or obstructing a peace officer.

Prosecutors say they concluded it was unlikely a jury would convict Ho.

They also say they were still investigating whether to bring charges against the officers who arrested Ho.

Ho’s roommate captured the Sept. 3 arrest on video, which showed officers hitting Ho with a baton and using a stun gun on him.

Police had been called after a confrontation between Ho and his roommate.
