Judge to consider change of venue for DUI trial of man accused of killing Angels pitcher

Change of venue considered in Gallo trial
SANTA ANA, Calif. — A judge is expected to decide whether the trial of a suspected drunken driver accused of killing an Angels pitcher and two others should be moved out of Orange County.
Orange County Superior Court Judge Richard Toohey on Friday will consider the change of venue motion by Andrew Thomas Gallo. His attorney has argued Gallo can’t receive a fair trial in a county where the Angels have a large fan base.
Gallo is charged with three counts of second-degree murder for the deaths of promising pitcher Nick Adenhart and his friends Courtney Stewart and Henry Pearson.
Police say Gallo’s blood-alcohol level was almost three times the legal limit on the night of the April 2009 crash.
