HIV-positive Kan. airman faces hearing on assault
WICHITA, Kan. — A Topeka woman says she would not have had sex with an airman if she had known he was HIV positive.
The woman testified Tuesday during a military hearing for Tech. Sgt. David Gutierrez, who is accused of having unprotected sex with at least 11 people without telling them he had HIV.
She says the 43-year-old Gutierrez told her he didn’t have any sexually transmitted diseases and that she trusted him because she believed people in the Air Force have integrity.
Special Agent Richard Toth testified that military authorities found out about Gutierrez’s sexual activities from his wife, who was concerned he was not telling his sexual partners of his HIV status.
