Kan. abortion doctor’s killer’s petition dismissed

WICHITA, Kan. — A Kansas judge has dismissed a petition filed by the man convicted of killing an abortion provider that complained about jail conditions and requested that he be released.

The habeas corpus petition filed by Scott Roeder (ROH’-dur) in February was dismissed Friday at the request of his court-appointed attorney.

The judge ruled that the petition is moot because it complains of conditions at the Sedgwick County jail. Roeder is now being held at the state prison in El Dorado, and the Sedgwick County court has no jurisdiction there.

Roeder gunned down Dr. George Tiller in May 2009 as he was serving as an usher in the foyer of the doctor’s church in Wichita.
