New trials ordered in Texas swinger’s club case

HOUSTON — An appeals court has overturned the convictions of two Texas men accused of grooming children as young as 5 years old to perform in sex shows.

The 14th Court of Appeals in Houston on Thursday ordered new trials for Patrick “Booger Red” Kelly and Jamie Pittman.

Both men were sentenced to life in prison in 2008. A jury had found Kelly guilty of engaging in organized criminal activity. Pittman was convicted of aggravated sexual assault of a child.

The three-judge panel agreed with Kelly’s claim that he had not been allowed to present a proper defense.

The judges said “prejudicial evidence” of other sexual offenses allegedly committed by Pittman and others was wrongly allowed at trial.
